UK GDPR & PECR — what governs your outreach
Building a list from public Google Maps listings is legal — the rules that matter kick in once you start contacting the businesses on it. Two separate frameworks apply:
UK GDPR governs the data, PECR governs the send
Post-Brexit, the UK runs its own near-identical version of GDPR ("UK GDPR") for how you may collect and process business data. Separately, the Privacy and Electronic Communications Regulations (PECR) specifically govern unsolicited marketing calls, emails, texts, and faxes — and PECR is the one that actually restricts your outreach.
B2B cold email needs a "soft opt-in" or equivalent basis
PECR's soft opt-in exemption lets you email a business contact without prior consent if the message is about a similar product/service to one they'd reasonably expect, and you give a clear opt-out on every message. Cold-emailing a scraped list without any prior relationship falls outside this exemption in most interpretations — treat first-touch email carefully.
Cold calling businesses is more permissive — check the TPS first
The Telephone Preference Service (TPS) and Corporate TPS (CTPS) let organisations opt out of unsolicited sales calls. B2B cold calling is broadly allowed under PECR, but any number registered on the CTPS should be excluded from live-dial campaigns.
The ICO enforces both, with real fines
The Information Commissioner's Office enforces UK GDPR and PECR and has fined companies over unlawful B2B marketing calls and emails. This is general orientation, not legal advice — have a UK data-protection solicitor review your outreach flow before scaling it.
